Terms & Conditions

Introduction

The details set out in these Terms & Conditions are to protect you, the customer, and myself, CreativePilot. The terms stated below must be adhered to and understood by the customer. If you wish to ask any questions regarding any points mentioned below then please do not hesitate to contact me.

Video, Editing, Motion and VFX Terms


1. Location Permissions

When filming on site, permissions must be collected by the customer unless otherwise agreed. I am not responsible for the licensing and/or permissions needed to film on a premises. Furthermore, if upon arriving to the filming location and a permit/license/agreement are not in place then filming will be suspended.


2. Setup & Pack Up

Depending on the size and/or complexity of your shoot, I/we will require setup time prior to the beginning of filming. This may be at the very beginning of the shoot and also throughout the filming period. Please allow up to 30 minutes of setup time if your shoot is complex or large size. Please allow a minimum of 15 minutes for smaller sized shoots. Setups are not charged apart from interviews, where more setup time is required.

3. Editing & Revisions

I do not offer a sit down editing service. Editing will be completed in-house unless agreed otherwise. Revisions will be sent to the customer for review where changes can be requested. Customers are allowed up to 2 revisions before changes become chargeable. Minor changes that take under 30 minutes will not be charged outside of the revision window.

E.g. if you have already had 2 revisions and you request a change that will take less than 30 minutes, you will not be charged.

Please be aware that the time minor changes take will be added up. Once the time has equalled or exceeded 60 minutes, all further changes become chargeable.

4. Footage Rights

Your final video becomes your right to use and distribute once you have paid the full amount. Prior to this, the video is still under my control and right to hold.

I do not provide RAW files unless explicitly agreed to otherwise.

All footage captured is stored on secure hard-drives or online cloud storage that can only be accessed by me or agreed 3rd parties (secondary editors etc.). All requests for any of the footage captured, in its RAW format or not, will not be accepted.

In a rare circumstance, if already agreed that the footage is to be released to the customer, then a charge will be in place as this footage can be used for unlimited publishable content. You, as the customer and the receiver of the footage, are responsible to gather storage space or a physical hard-drive sufficient enough to hold the footage required.


5. Music Licensing

To comply with copyright law, I require all music used in the final video to be licensed. This will likely come with a charge and will need to be settled before the release of the end product. Music that has not be licensed will result in the video being held, (not being released to you).

I use Epidemic Sound, Musicbed and Artlist for music sourcing. Feel free to browse their websites to get an idea of the licensing costs that may be involved in your project.


6. Distribution

Once you have paid the final full amount of your video, you will own the final end product. Please be aware that there may be distribution limitations on your video. I personally do not place limitations on where you show and what you do with your video but licensing of music will. I cannot be held accountable for the incorrect distribution of your video once out of my control.

E.g. you may have paid for a standard Epidemic Sound license which only permits you to sharing the video online with an ad spend of up to €1,000. This means, under the current license, you cannot distribute the video to a wider media including TV, radio and multi-media.

7. Damage & Breakage

Any damage inflicted on the equipment being used will result in a charge dependant on the severity of the damage and the item in question. A full breakage will require a replacement to be purchased. The customer will be responsible for settling this fee for replacement equipment.


8. Weather

If filming in an outdoor environment, or a premises susceptible to weather conditions, there may be an eventuality where the filming is cancelled. The equipment I use is not weather-proof. If rescheduling of the filming is required then this will be sorted as soon as possible and you will not be charged for cancelled filming. If part of the filming has been completed before closing down due to weather conditions, you will be charged for the part that has been successfully completed.


9. Cancellations

Cancellations adhere to a work completed to date rule. This means if you cancel after filming has commenced then you will need to settle your 50% upfront fee, if you haven't done so already.

If you have received a first draft/rough cut then you will need to settle the full amount unless otherwise agreed.

Cancellations before starting the project require at least 1 weeks' (7 days) notice. Failing that, a charge of £100.00 will be in effect to cover pre-production costs.


10. Social Media Mentions & Tagging

You are allowed to mention or tag CreativePilot in any work that has been carried out by myself or work that I have been actively involved in only. Any other mentions or references to CreativePilot where it is clear the media has not been agreed to or supplied by myself will be ignored and reported.


11. Drone Footage

I do not offer drone footage. If you wish to include drone footage in your video there are options. You or I can source drone stock footage to use in your video. Charges apply. You may seek help from a CAA certified drone pilot. Please ensure that the drone pilot you choose has the ability to record in at least 4K at 25fps. I am not responsible for the quality and/or end result of your drone footage.


12. COVID-19

In the event that I or you test positive for COVID-19, on site filming will be postponed.


13. Changes to Prior Agreement

Changes to the ‘scope’ or prior agreement will result in an additional charge. The size of the charge will be determined by the requested change(s).


14. Extended Media Usage

Footage captured for your project may be used in showreels, social media posts and other forms of material for marketing purposes. If you do not wish to have a part of, or any of your footage used in marketing material, then please let me know.

15. Payment Terms

All final payments, whether in full or a remainder of the overall charge, unless otherwise stated in a quote/statement of work, must be made within 14 days of the final delivery of the video(s).

A 50% upfront payment is required to commence work on any project. This payment can be made from the date of the signed agreement or within 7 days of the completion of filming. If the project is cancelled after filming has been completed, the 50% payment is still required.

Website Terms


1. Hosting

Websites are hosted with Webflow. Webflow hosts websites on Amazon's AWS Network using Cloudflare and Fastly as upstream providers. CreativePilot does not host your website. You, the client, are responsible for hosting your own website via a valid Webflow account. You must pay Webflow directly for the ongoing hosting of your website to keep it active.


2. Updates & Amendments

Updates and amendments to existing text and imagery is charged based on the request. Changes to structure and/or design layout will be charged accordingly at a higher rate in accordance with the request.

3. Copyright

CreativePilot holds no legal obligation to obtain copyright licensing for any content, including images and video media, that appears on a client's website. All agreements and/or licenses must be obtained by the client. Any material without a valid license will be rejected.

4. Payment

CreativePilot offers one-time payments for the initial build and design of the website. 50% is required before commencement of the project with the remaining 50% required after the completion of the build but before the site is pushed live for public viewing.

5. Domain Name Registration & Ownership

Domains can be bought with domain name providers such as 123 Reg, GoDaddy etc. CreativePilot does not purchase nor manage your domain names. These must be purchased and managed by the client. CreativePilot holds no responsibility for your domain name(s). The only connection between CreativePilot and your domain name is the initial connection between your new website and the domain.

6. Website Ownership

Once you have made your final payment, you own your website in your Webflow Dashboard. CreativePilot then becomes a freelance designer available should you need assistance with your website. Please be aware there are charges for updates made to your website stated above in section '2. Updates & Amendments'.

7. Prohibited Content

CreativePilot reserves the right to restrict content the company deems as prohibited. Such content consists of the following:

  • Adult themes
  • Abusive content and/or language
  • Promotion of violence including terror and propaganda
  • Racial, sexual or any other discriminative content including age and political nature
  • Slanderous or libel content
  • Other content CreativePilot deems inappropriate

The definition of the above content is left to CreativePilot's discretion.

8. Security

CreativePilot holds no responsibility for the security of your website and its assets. As stated in '1. Hosting' CreativePilot does not host your website and so cannot claim any responsibility for security as this does not lie within the company's control. Webflow, Cloudflare, Fastly and Amazon's AWS host your website and therefore security control falls to said organisations. Please check the stated organisations security policies for more accurate detail.

9. E-Commerce

If you require an E-Commerce website, this will be built using Webflow's E-Commerce package. CreativePilot will assist with the connection to a payment provider of your choice but responsibility of this payment provider relies solely with the client. CreativePilot holds no responsibility for any damage, loss or fraud to profits or any income. The client must be responsible for managing their own E-Commerce payment solutions.

Changes to Terms & Conditions

CreativePilot reserves the right to change the Terms & Conditions stated above at any time without notification. Changes will be posted on this page. Continuation of any service means you accept any changes that have been made.
